{"id":54,"date":"2020-11-05T09:26:13","date_gmt":"2020-11-05T14:26:13","guid":{"rendered":"https:\/\/courses.bowdoin.edu\/history-2203-fall-2020-edudley\/?page_id=54"},"modified":"2020-12-21T16:01:20","modified_gmt":"2020-12-21T21:01:20","slug":"your-choosing-ii","status":"publish","type":"page","link":"https:\/\/courses.bowdoin.edu\/history-2203-fall-2020-edudley\/your-choosing-ii\/","title":{"rendered":""},"content":{"rendered":"<p>&nbsp;<\/p>\n<p><span data-contrast=\"auto\">In 2004, there was a court case filed in New York district courts on behalf of Vietnamese Agent Orange <\/span><span data-contrast=\"auto\">victims<\/span><span data-contrast=\"auto\"> (<\/span><span data-contrast=\"auto\">Palmer 2007). The case was filed against multiple chemical <\/span><span data-contrast=\"auto\">corporations but<\/span><span data-contrast=\"auto\"> was dismissed in March with the court siting a lack of evidence that Agent Orange was the common factor of injury (Palmer 2007). <\/span><span data-contrast=\"auto\">Eventually<\/span><span data-contrast=\"auto\">, during this suit the government revealed that it was aware of the dangers from the chemicals in the early 1960s (Palmer 2007).\u00a0The case was appealed eventually to the Supreme Court, who refused to hear the case\u00a0leaving Vietnamese victims without another way to file a civil suit (Cusato 2018).\u00a0\u00a0<\/span><span data-contrast=\"auto\">This ironically happened <\/span><span data-contrast=\"auto\">thirteen<\/span><span data-contrast=\"auto\"> years after the Agent Orange Act passed through <\/span><span data-contrast=\"auto\">Congress making it possible for U.S. veterans to receive compensation for health effects of the chemicals. <img loading=\"lazy\" decoding=\"async\" class=\"wp-image-129 alignleft\" src=\"https:\/\/courses.bowdoin.edu\/history-2203-fall-2020-edudley\/wp-content\/uploads\/sites\/461\/2020\/12\/Screen-Shot-2020-12-21-at-3.47.38-PM-1-300x62.png\" alt=\"\" width=\"435\" height=\"90\" srcset=\"https:\/\/courses.bowdoin.edu\/history-2203-fall-2020-edudley\/wp-content\/uploads\/sites\/461\/2020\/12\/Screen-Shot-2020-12-21-at-3.47.38-PM-1-300x62.png 300w, https:\/\/courses.bowdoin.edu\/history-2203-fall-2020-edudley\/wp-content\/uploads\/sites\/461\/2020\/12\/Screen-Shot-2020-12-21-at-3.47.38-PM-1-1024x210.png 1024w, https:\/\/courses.bowdoin.edu\/history-2203-fall-2020-edudley\/wp-content\/uploads\/sites\/461\/2020\/12\/Screen-Shot-2020-12-21-at-3.47.38-PM-1-768x157.png 768w, https:\/\/courses.bowdoin.edu\/history-2203-fall-2020-edudley\/wp-content\/uploads\/sites\/461\/2020\/12\/Screen-Shot-2020-12-21-at-3.47.38-PM-1-1536x315.png 1536w, https:\/\/courses.bowdoin.edu\/history-2203-fall-2020-edudley\/wp-content\/uploads\/sites\/461\/2020\/12\/Screen-Shot-2020-12-21-at-3.47.38-PM-1-2048x420.png 2048w, https:\/\/courses.bowdoin.edu\/history-2203-fall-2020-edudley\/wp-content\/uploads\/sites\/461\/2020\/12\/Screen-Shot-2020-12-21-at-3.47.38-PM-1-1200x246.png 1200w\" sizes=\"auto, (max-width: 435px) 85vw, 435px\" \/><\/span><\/p>\n<p><span data-contrast=\"auto\">In 1966, Hungary challenged the United States use of the chemicals under international law (<\/span><span data-contrast=\"auto\">Cusato 2018). This would be the first <\/span><span data-contrast=\"auto\">time<\/span><span data-contrast=\"auto\"> that the U.S. had to defend its actions <\/span><span data-contrast=\"auto\">in front<\/span><span data-contrast=\"auto\"> of <\/span><span data-contrast=\"auto\">an international sphere (Cusato 2018). <\/span><span data-contrast=\"auto\">The <\/span><span data-contrast=\"auto\">Geneva <\/span><span data-contrast=\"auto\">Protocall<\/span><span data-contrast=\"auto\"> which <\/span><span data-contrast=\"auto\">outlines<\/span><span data-contrast=\"auto\"> war crimes and regulations specifically <\/span><span data-contrast=\"auto\">outlines<\/span><span data-contrast=\"auto\"> chemical agents that have a direct negative impact on people<\/span><span data-contrast=\"auto\">\u00a0as prohibited \u201cbacteriological methods of <\/span><span data-contrast=\"auto\">warfare<\/span><span data-contrast=\"auto\">\u201d (<\/span><span data-contrast=\"auto\">Cusato 2018).<\/span><span data-contrast=\"auto\">\u00a0This same section of the <\/span><span data-contrast=\"auto\">Geneva<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">Protocall<\/span><span data-contrast=\"auto\"> also makes clear that the international law applies generally and can hold a state accountable regardless of that <\/span><span data-contrast=\"auto\">state&#8217;s<\/span><span data-contrast=\"auto\"> participation in the accords<\/span><span data-contrast=\"auto\">\u00a0(Cusato 2018). This particular <\/span><span data-contrast=\"auto\">section of the accords<\/span><span data-contrast=\"auto\"> is important to the U.S. case as the United States did not sign onto the accords until 1975, when the spraying was already <\/span><span data-contrast=\"auto\">done (<\/span><span data-contrast=\"auto\">Palmer 2007).<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">The U.S. refuted <\/span><span data-contrast=\"auto\">all the<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">claim<\/span><span data-contrast=\"auto\">s from the international community by claiming\u00a0<\/span><span data-contrast=\"auto\">that the law did not ban <\/span><span data-contrast=\"auto\">herbicides<\/span><span data-contrast=\"auto\"> nor <\/span><span data-contrast=\"auto\">was the <\/span><span data-contrast=\"auto\">herbicide<\/span><span data-contrast=\"auto\"> used with the direct intent of causing harm (Cusato 2018). This led to <\/span><span data-contrast=\"auto\">further investigations and international pressure <\/span><span data-contrast=\"auto\">for the U.S. to end the war and admit to wrongdoings against Vietnam (Cusato 2018).\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:720,&quot;335559739&quot;:160,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Even though<\/span><span data-contrast=\"auto\"> the U.S. continues to not accept fault or fully <\/span><span data-contrast=\"auto\">accept<\/span><span data-contrast=\"auto\"> the <\/span><span data-contrast=\"auto\">damages<\/span><span data-contrast=\"auto\"> of the chemicals, the Bush administration stating projects to assist Vietnam in 2006 (<\/span><span data-contrast=\"auto\">Cusato 2018). <\/span><span data-contrast=\"auto\">The United States has assisted in cleanup of chemically concentrated \u201chotspots\u201d as well as donated to general disability funding (Cusato 2018). <\/span><span data-contrast=\"auto\">None of<\/span><span data-contrast=\"auto\"> this however is considered reparations, and instead is <\/span><span data-contrast=\"auto\">referred<\/span><span data-contrast=\"auto\"> to as \u201cVoluntary <\/span><span data-contrast=\"auto\">Remedition<\/span><span data-contrast=\"auto\">\u201d taking any burden of <\/span><span data-contrast=\"auto\">perceived<\/span><span data-contrast=\"auto\"> guilt or <\/span><span data-contrast=\"auto\">wrongdoing<\/span> <span data-contrast=\"auto\">from<\/span><span data-contrast=\"auto\"> the United States (Cusato 2018).<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">While the united states <\/span><span data-contrast=\"auto\">were<\/span><span data-contrast=\"auto\"> not held accountable for this chemical and ecological <\/span><span data-contrast=\"auto\">warfare<\/span><span data-contrast=\"auto\"> under the law, <\/span><span data-contrast=\"auto\">international scrutiny and discussions of the international law could lead to improved clarity for future conflict. At this point the science is clear enough in the harms that <\/span><span data-contrast=\"auto\">chemicals<\/span><span data-contrast=\"auto\"> like Dioxin in Agent Orange can cause. <\/span><span data-contrast=\"auto\">Considering the backlash against these actions and the impacts that continue to afflict <\/span><span data-contrast=\"auto\">millions<\/span><span data-contrast=\"auto\"> of people decades later, it seems <\/span><span data-contrast=\"auto\">likely<\/span><span data-contrast=\"auto\"> that future instances of chemical <\/span><span data-contrast=\"auto\">warfare<\/span><span data-contrast=\"auto\"> against people will not be easily written off an accident.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:720,&quot;335559739&quot;:160,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p>It is evident that while the discussion around Agent Orange has changed, there are still implications from the disaster to this day. As of 2008, the Veterans Association had nineteen diseases and disabilities in U.S. veterans and their children as reason for government compensation (Veterans Affairs).
